A Regular Board Meeting of the Town of St. Armand was held on the above date at the Town Hall, Bloomingdale, NY.

Notice was posted regarding the date of this meeting.
Supervisor Whitson called the Public Hearing to order at 6:30 p.m.
Councilperson Fuller led the Pledge of Allegiance.
PUBLIC HEARING – PROPOSED LOCAL LAW 3 OF 2015 – WASTEWATER REGULATIONS
As all parties present had a written copy of the following notice, the reading was waived by Supervisor Whitson.

NOTICE OF PUBLIC HEARING
PROPOSED LOCAL LAW NO. 3 of 2015
PLEASE TAKE NOTICE that the Town Board of the Town of St. Armand, New York, will meet at the Town Hall, 1702 NYS Rt. 3, Bloomingdale, New York, on the 11th day of August, 2015 at 6:30 PM. for the purpose of conducting a Public Hearing on introducing proposed Local Law No. 3 of 2015 entitled “Regulations for All Users of Wastewater Collection and Disposal Systems in the St. Armand Sewer District”.
PLEASE TAKE FURTHER NOTICE that at said Public Hearing to be held at the time and place set forth above, the Town Board will consider this Local Law and hear all parties interested therein concerning the same.
PLEASE TAKE FURTHER NOTICE that a copy of the full text of proposed Local Law No. 3 of 2015 may be obtained upon request from the Town Clerk of the Town of St. Armand.
PLEASE TAKE FURTHER NOTICE there will be a REGULAR Board meeting immediately following the Public Hearing for the purpose of possible adoption of said Local Law and any other business to come before the Town Board.

Supervisor Whitson asked for comments, none were made.
Deputy Supervisor Grimone made a motion to close the Public Hearing and enter the Regular Board Meeting, Councilperson Fuller seconded the motion, all approved.

Resolution 44 of 2015
RESOLUTION OF THE ST. ARMAND TOWN BOARD
ADOPTING LOCAL LAW NO. 3 OF 2015
Regulations for All Users of the Wastewater Collection and Disposal System in the St. Armand Sewer District.
The following Resolution was offered by Councilperson Amell:
WHEREAS, the Town Board wishes to consider adoption of Local Law No. 3 of 2015 to Regulate All Users of the Wastewater Collection and Disposal System in the St. Armand Sewer District, and
WHEREAS, this legislation is authorized in accordance with the Town’s police powers and by New York State Town Law Section 130; and
WHEREAS, the Town Board scheduled a Public Hearing on this Local Law to be held at 6:30 p.m. on August 11, 2015; and
WHEREAS, notice of such Public Hearing was duly posted and published in accordance with law; and
WHEREAS, the Town Board duly held a Public Hearing on the proposed Local Law on August 11, 2015 and heard all interested persons;
NOW, THEREFORE, BE IT RESOLVED, that the St. Armand Town Board hereby finds that it is in the best interest of the public health, safety and welfare to regulate wastewater in the Town of St. Armand; and
BE IT FURTHER RESOLVED, that the St. Armand Town Board hereby adopts Local Law No. 3 of 2015; and
BE IT FURTHER RESOLVED, that the St. Armand Town Board hereby authorizes and directs the Town Clerk to file the Local Law with the New York Secretary of State in accordance with the provisions of the Municipal Home Rule Law and acknowledges that the Local Law will take effect immediately upon filing by the Secretary of State.
This Resolution was seconded by Deputy Supervisor Samuel Grimone, and adopted by roll-call vote as follows: All Aye
WATER DEPARTMENT MONTHLY REPORT
Water Superintendant Jeff Cotter reviewed his written report with the Board. This report is kept on file in the Office of the Town Clerk and is available for review by the general public upon request.
CODE ENFORCEMENT OFFICER’S REPORT
CEO Robert Hammond was excused, but provided his written report to the Board. This report is kept on file in the Office of the Town Clerk and is available for review by the general public upon request.
HIGHWAY SUPERINTENDENT MONTHLY REPORT
Highway Superintendent Roger Oliver was excused, put provided his written report to the Board. This report is kept on file in the Office of the Town Clerk and is available for review by the general public upon request.
MOTION TO PAY MONTHLY BILLS
Councilperson Fuller made a motion to pay this month’s bills; the motion was seconded by Councilperson Bates. All agreed. Motion carried
MONTHLY REPORT FROM THE SUPERVISOR
Supervisor Whitson gave the Board the Supervisor’s monthly financial report. This report is kept on file in the Office of the Town Clerk and is available for review by the general public upon request. Councilperson Fuller made a motion to accept the Supervisors report; Deputy Supervisor Grimone seconded the motion. All approved. Motion carried. Supervisor Whitson led discussion on Grants for Sewer lines and the Bloomingdale Volunteer Fire Department contract.
REVIEW AND APPROVAL OF PREVIOUS MINUTES
Councilperson Amell made the Motion to approve minutes of the Regular Board Meeting July 14, 2015. Councilperson Bates seconded the motion, all approved, motion carried.
TOWN CLERK MONTHLY REPORT
Town Clerk Davina Thurston gave the Board the monthly report for July 2015. This report is kept on file in the Office of the Town Clerk, and is available to the general public upon request.
WATER & SEWER BILLING MONTHLY REPORT
Water & Sewer Clerk Davina Thurston gave the Board an oral report for the 3rd quarter billing cycle.
NEW BUSINESS
2016 BUDGET WORK SESSIONS
After discussion, the Board decided to hold 2016 Budget Work Sessions on Wednesday, October 7th, 2015 at 6:30 pm, Wednesday October 14th at 6:30 pm and Wednesday October 28th at 6:30 pm. The Public Hearing for the 2016 Budget was scheduled for Tuesday, November 10th at 6:30 pm prior to the Regular Board Meeting. All will take place at the Bloomingdale Town Hall.
OLD BUSINESS
Supervisor Whitson led the discussion on the use of the Town Hall by Religious Groups, the Article 7 Lawsuit that is being filed against the Town, the Over 55 Club and internet for Water Superintendent and Code Enforcement Officer.
MOTION TO ADJOURN
Deputy Supervisor Grimone made a motion to adjourn, seconded by Councilpersons Amell. Supervisor Whitson adjourned the meeting at 7:47 pm.
