Town of St Armands Board Meetings

Meeting minutes were approved on November 10, 2016.

A Regular Board Meeting of the Town of St. Armand was held on the above date at the Town Hall, Bloomingdale, NY.


Town Supervisor Charles Whitson, Jr., Deputy Supervisor Donald Amell, Councilperson Jennifer Fuller, Councilperson D. Joseph Bates, Councilperson Dean Montroy.


Deputy Highway Superintendant Roger Oliver, Water Superintendant Jeff Cotter, Wastewater Superintendant Stan Ingison, Code Enforcement Officer Robert Hammond, Town Clerk Barbara Darrah.


Jean Baltzly and Peter Wood, representing the Tri-Lake Humane Society, and Sandy Hayes.

Notice was posted regarding the date of this meeting.

Supervisor Whitson called the meeting to order at 6:30 p.m.

Supervisor Whitson led the Pledge of Allegiance.


Jean Baltzley and Peter Wood, Board members of the Tri-Lakes Humane Society, presented a brief session on the functions of the animal shelter and its role in the communities. One important point made was the money collected from the Tri-Lakes Shelter canisters that you see in stores goes entirely to the Spay and Neuter Program. They also presented statistics on the shelter’s numbers: 80-100 cats and 17-20 dogs housed there. A promotional voucher program is currently being offered: anywhere from $25 for a cat up to $55 for a large dog helps defray costs for families wanting to adopt an animal who could not afford otherwise. Brochures were left at the Town Hall for review by residents. Lastly, they encouraged anyone spotting stray cats or dogs to call the New York State Police who will in turn contact the Animal Control Officer.


Deputy Highway Roger Oliver presented the following report:

Roger Oliver reported the 40’ culvert project from Main St. to St. Regis Avenue was completed. The sand pile is completed and ready for winter weather use. Roger stated Luck Brothers is going to pave the Oregon Plains Road when they pave the County Road by the beginning of November. Roger inquired if any decisions were made on re-doing Main St. manholes, as they are rotting. Discussion ensured and it was determined it would be considered for the 2018 budget.


Water Superintendant Jeff Cotter gave the following written report to the Board:

Town of St. Armand Water Report for 10/11/16 Board Meeting

    1. Monthly Coliform Lab Samples - 3 Monthly samples were submitted to Life Science Lab to test for Coliform bacteria, all samples came back negative.

    2. Stage 2 Disinfection Byproduct Samples - The sample results finally came back and the results were normal.

    3. Marked water service connection locations for contractors installing the new sewer line on St. Regis Ave.

    4. Purchased 3 Curb Stops from Ferguson Water Works for upcoming projects and for stock items.

    5. Test Ran Both Generators with no issues.

    6. Reduced Well #5 run time by 2 hours per day - Our consumption is down to 44,000 per day, on average.

    7. Wet Tap for Corporation Stop Installation Possible This Month on Maple St. - I received a call from a plumber who works for Mark Trudeau. They are planning on installing a service connection for a new residence at the end of Maple St. later this month. I will work with them installing a new Corporation Stop for their service connection.

    8. 9/28/16 - Per Barb's request, I took water readings at 27 Mathew Way and 21 School St. I also turned on the water to 27 Mathew Way. The water had been off since last summer. I checked for leaks under the trailer with the new owner prior to leaving the residence.

    9. 9/27/16 - Luck Brothers hit and broke the service connection line feeding John Heverly's residence on St. Regis Ave. The contractors repaired the break.

    10. 9/29/16 - John Heverly Reader Replacement - I replaced the reader for John Heverly in an unrelated request. John was looking at replacing his meter in his house and I suggested trying to replace the reader first as this would be much cheaper than replacing the meter. I will monitor the reader to ensure this corrects his problem.

    11. 10/5/16 - Received call about Town's Policy this Winter in Regards to Allowing Residents to Run Their Water in Extremely Cold Winters to Prevent Service Connection Freeze-ups ? - Are we going to continue to allow this?

    12. 10/6/16 - Took 6 Meter Reader Readings For Barb Per Her Request Prior to Billing for the Quarter. There are also several new Badger digital readers that need reprogramming AGAIN. I'm uncertain why these new digital readers need constant reprogramming.

    13. 10/6/16 - Martha Brink Request to Locate Her Curb Stop - I received a call from Martha Brink on Rt #3 to locate her curb stop shutoff to allow for the installation of a new PRV at her residence. I had located her curb stop last year, however I located the curb stop again for her. The curb stop is broken and needs to be dug up for repair. Charlie and I both informed Martha that we would work with her on locating the curb stop, however we told her that it was her responsibility to dig it up and repair it. I marked the location, let her borrow a shovel and gave her a map showing the exact location of her curb stop.

Jeff asked Charlie Whitson to contact Hulbert’s Tri-Lake Supply for a manual to lock the new digital meter readers in order to assist in more accurate water usage readings.


Wastewater Superintendent Stan Ingison provided the following report:

Town of St. Armand Wastewater Summary Report for the October 2016 Meeting

    1) The grit system was still acting up and calling out alarms so I was working with Todd to find the problem. After a while it seemed more like a SCADA system issue and I got Andy to work with me to re-calibrate the system meters and things seem to be working now but still needs more adjusting.

    2) Joe Watson of Core Climate Systems has ordered the battery backup unit for the Pre-treatment building PTB climate system and will install it as soon as it arrives. This should eliminate the false alarm issues we have been getting after power outages. It won’t correct the telephone outage issues though.

    3) The blower room ventilator continues to trip out about once a month but I can get it reset and re-started again but I will try to search down what the problem is that is causing it to happen.

    4) AES is working on the punch list items left to be done such as getting parts for the PTB crane unit, making a number of corrections and improvements to the SCADA board in the PTB and the main plant, Reset the unusable valve boxes at the main plant to a working order, getting replacement filters for the blower air intake line, fix drainage issues in the polymer feed manhole area along with getting the polymer feed unit issues up to date.

    5) I am still working toward getting the East Main street sewer main opened up and cleaned out; hopefully with help from Saranac Lake.

    6) The algae and solids situation has still continued to improve itself, there remains more plant cover on the lagoon but the algae and bug numbers are still pretty much gone at least at this time of year.

    7) Erica did manage to reconfigure the computer and get it back up and running for the time being. Hopefully it will continue to operate until we get a computer capable of handling the needs of the plant.

    8) The St. Regis St. sewer main pipe and man hole installation is basically done with bench work, rim attachments, cleanout leveling, roadway work and pavement still left to complete. The Pump House lift station parts have been coming in and solar panel project preparation work is underway.

    9) With the computer being down the net-DMR reporting system work was delayed. I am trying to get back into it now but I need to get the outdoor I & M plan work done while we still have the weather. I am doing the manhole inspections that are on the list for this year.

    10) The higher phosphorous level in last month’s effluent sample ended up being below the permitted level because the flow was so low with the dry weather. I still need to start looking into methods for removing phosphorous from the system for the future.

    11) Working on closing out warranty items. Riznick is working on valve boxes, reed bed sealing and Davit Crane operation.

• 16-SA-020: Ed & Nancy Anthos (White Pine Cabin) Permit, 16 Maple St. – New Dwelling
o Foundation permit issued, waiting for notification of Start of Work.

• 16-SA-002: Erica Neufeld/Apex Solar Power, 675 NYS Rte. 3 – Re-roofing
o Apex Solar Power (Apex) was charged an early start Fee for the Re-roofing Project.
o Solar Panel Project to be issued CO pending Engineer-of-Record inspection and certification.

• 16-SA-034: Matt and Joy Kasson, 1225 NYS Rte.3 – New Enclosed Deck Project
o Project started without a Permit. A Stop Work Order was issued.
o Property Owner / Contractor submitted Application, Conditional Permit was issued.
o Certificate of Workers’ Compensation could not be secured. Stop Work Order was reinstated.

• 16-SA-035: Bettijane Forrester, 23 James Way – Roof Replacement and New Covered Deck Project
o Applicant called after project was completed and there were issues.
o Permit was filed, inspection performed identifying non-conforming items, permit review is in progress.

o Pre-application meetings, and permit review have been completed. Notice of Incomplete Application was issued.
o Additional discussion with Applicant on Braced Wall Lines is needed.

• 16-SA-037: Patrick Dupree, 1437 State Rte. 3 – New Residential Dwelling
o Application submitted and found to be incomplete.
 No Site Plan.
 No Certificates of Insurance.
 Minor technical items.
 No payment.

o Application submitted for Re-Roofing, Complete

o Pre-Framed Dwelling Delivered.

o Called for Final Inspection.
o Items missing: Final Electrical, Chimney Inspection and Railing installation is incomplete.

• 16-SA-017: Danielle Akey, 34 Poplar Lane – Addition
o Order to Remedy issued due to non-conforming items and occupancy prior to Certificate of Occupancy.


Councilperson D. Joseph Bates made a motion to pay this month's bills; the motion was seconded by Councilperson Jennifer Fuller. All agreed. Motion carried.


Supervisor Whitson gave the Board his monthly report. This report will be kept on file in the Office of the Town Clerk and is available to any interested party. Deputy Supervisor Donald Amell made a motion to accept the Supervisor's report for September 2016; seconded by Councilperson Jennifer Fuller. All approved. Motion carried.


Deputy Supervisor Donald Amell made the motion to approve the minutes of Regular Board Meeting, September 13, 2016. Motion seconded by Councilperson Dean Montroy. All approved. Motion carried.


Town Clerk Barbara Darrah gave the following report for the month of September 2016:

Water & Sewer Clerk Barbara Darrah gave the Water & Sewer Receivables Report of $88,920. balance due for all accounts.



The following Resolution was offered by Councilperson D. Joseph Bates:

WHEREAS, by Resolution No. 1 duly adopted on October 11, 2016, the Town of St. Armand introduced Local Law No. 1 for 2016, entitled “ A Local Law to Override the Tax Levy Limit Established in General Municipal Law ss3-c”; and

BE IT RESOLVED, that a Public Hearing was duly held on the 11th day of October 2016, at seven o’clock in the forenoon to hear any and all persons concerning the adoption of said local law; and

BE IT FURTHER RESOLVED, that the Town of St. Armand Town Board hereby adopts proposed Local Law No. 1 of 2016 entitled “Local Law No. 1 – A Local Law To Override the Tax Levy Limit Established in General Municipal Law ss3-c”, reading and providing as follows:


A Local Law To Override the Tax Levy Limit Established in General Municipal Law ss3-c.

BE IT ENACTED, by the Town of St. Armand Town Board as follows:

Section 1. Legislative Intent.

It is the intent of this local law to override the limit on the amount of real property taxes that may be levied by the Town of St. Armand pursuant to General Municipal Law ss3-c, and to allow the Town of St. Armand to adopt a budget for the fiscal year 2017 that requires a real property tax levy in excess of “tax levy limit” as defined by General Municipal Law ss3-c.

Section 2. Authority.

This local law is adopted pursuant to subdivision 5 of General Municipal Law ss3-c, which expressly authorized the Town Board to override the tax levy limit by the adoption of a local law approved by vote of sixty percent (60%) of the Town Board.

Section 3. Tax Levy Limit Override – Budget Authorization.

The Town Board of the Town of St. Armand hereby overrides the tax levy limit for the Town of St. Armand for 2017 and authorized the Town of St. Armand, after completing all required procedures for the adoption of a budget, to adopt a budget for 2017 that requires a tax levy that is greater than the tax levy limit calculated for 2017 pursuant to ss3-c of the General Municipal Law.

Section 4. Severability.

If any clause, sentence, paragraph, subdivision, or part of this Loacl Law or the application thereof to any person, firm or corporation, or circumstance, shall be adjusted by any court of competent jurisdiction to be invalid or unconstitutional, such order or judgement shall not affect, impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this local law or in its application to the person, individual, form or corporation, or circumstance, directly involved in the controversy in which such judgement or order shall be rendered.

Section 5. Effective Date.

This local law shall take effect immediately upon filing with the Secretary of State.

RESOLUTION 30 of 2016 - Standard Work Day and Reporting

The following Resolution was offered by Deputy Supervisor Donald Amell:

WHEREAS A Resolution of the Town Board of the Town of St. Armand approve the Standard Work Day and Reporting figures for the New York State Retirement System.

Standard Work Day and Reporting Resolution

BE IT RESOLVED, that the Town of St. Armand hereby establishes the following standard work days for elected and appointed officials and will report the following days worked to the New York State and Local Employees' Retirement System based on the time keeping system records or the record of activities maintained and submitted by these officials to the supervisor of this body:

I, Barbara J. Darrah, Town Clerk of the governing board of the Town of St. Armand, of the State of New York, Do hereby certify that I have compared the foregoing with the original resolution passed by such board, at a legally convened meeting, and that same is a true copy thereof and the whole of such original.

I further certify that the full board consists of __5__ members, and that __5___ of such members were present at such meeting and _5___ of such members voted in favor of the resolution.

A resident who lives off of Trudeau Road approached Deputy Supervisor Donald Amell regarding the visibility issues traveling from Trudeau Road onto Route 3. Due to this same issue, the speed limit was lowered from 55 mph to 45 mph a few years ago. Discussion ensued and Charles Whitson stated he would contact the state highway department.


There were no updates or changes in old business. Supervisor Whitson asked those present if there were any other questions or concerns. There were none.


Councilperson D. Joseph Bates made a motion to adjourn, seconded by Councilpersons Jennifer Fuller. All approved. Motion carried.
